3. Employment, Hiring & Program Disclaimer

IncomiQ may list or reference remote paid staff roles, certificate programs, and qualification pathways. You acknowledge and agree that:

• Participation in any program or qualification does not guarantee employment
• Applying, enrolling, or completing any program does not create an employment relationship
• Hiring and selection decisions are made solely at IncomiQ’s discretion
• Any paid work, if offered, is governed by separate written agreements

4. Legal Compliance and Prohibited Use

You agree to use IncomiQ products and services lawfully and not for any fraudulent, malicious, or unauthorized activity. Providing false information or misusing our systems may result in termination of access without refund.

• No unauthorized access to systems, networks, or accounts
• No malware distribution, exploitation of third-party software, or harmful payloads
• No attempts to bypass security controls on systems you do not own or explicitly have written permission to test

5. Technical & Security Restrictions (VM/Lab-Only)

Any technical content, software, lab activity, or demonstration provided by IncomiQ must be used only in controlled environments and within authorized scope. Unless IncomiQ provides written permission otherwise, you agree that technical testing and demonstrations will be performed:

• inside isolated virtual machines (VMs) or controlled lab environments
• against authorized targets only (IncomiQ-provided or participant-owned software explicitly approved)
• for lawful, ethical, and defensive purposes

Any use outside authorized scope may result in immediate termination and disqualification from IncomiQ programs.

6. Eligibility

• You must be at least 18 years of age.
• You must provide accurate contact and payment information.
• You must not use our services for unlawful, harmful, deceptive, or abusive purposes.

7. Payments & Processing

Payments may be accepted through PayPal, Zelle, or other approved payment processors. Purchases and enrollments are processed after payment confirmation. Pricing is listed in U.S. Dollars (USD) unless stated otherwise.

Access to digital content or assessment materials may be delivered by email or other approved method after confirmation.

8. Refund Policy

All sales are final. Refunds are not guaranteed and may be issued solely at the discretion of IncomiQ, unless otherwise stated in a separate written agreement.

Chargebacks or unauthorized disputes may result in termination and loss of access to current and future IncomiQ services.

For assessment or certificate programs, fees may become non-refundable once assessment materials are issued or access is granted, unless a separate written agreement states otherwise.

9. Intellectual Property

All materials, software, graphics, and written content provided by IncomiQ are the intellectual property of Nothing But Us LLC and/or Magnitude Corporation (or their licensors). You may not copy, redistribute, republish, reverse engineer, resell, or create derivative works from our content or tools without written permission or a valid license agreement.

10. Disclaimer of Warranties

All products and services are provided “as is” and “as available.” IncomiQ makes no warranties or guarantees regarding performance, accuracy, results, or suitability for any specific purpose. Individual results vary based on effort, experience, and environment.

11. Limitation of Liability

To the maximum extent permitted by law, Nothing But Us LLC, Magnitude Corporation, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of income, business, profits, or data
• Service interruptions, delays, or technical failures
• Errors, omissions, or content delivery issues
• Actions or decisions made based on IncomiQ materials, communications, or tools

12. Account, Access, and Termination

We may suspend or terminate access to any product, program, or service if we believe you violated these Terms, misused services, provided false information, or engaged in unsafe or unauthorized activity. Termination may occur without refund where permitted by law.
