1. Overview

IncomiQ.com ("IncomiQ") is operated by Nothing But Us LLC, a subsidiary of Magnitude Corporation ("Company," "we," "us," or "our").

These Terms of Service ("Terms") apply when you access our website, submit a service request, purchase services, communicate with us, or otherwise use products or services provided by IncomiQ.

By using IncomiQ, you agree to these Terms. If you do not agree, do not purchase or use our services.

2. Services

IncomiQ provides technology services to individuals, entrepreneurs, and businesses. Services may include:

  • Computer setup and technical troubleshooting
  • IT configuration and technology support
  • Microsoft 365, business email, and cloud configuration
  • Network and Wi-Fi setup
  • Backup and storage configuration
  • Cybersecurity reviews and security configuration
  • Account security and multi-factor authentication setup
  • Device, email, and network security
  • Custom software development
  • Web applications and internal business tools
  • APIs, databases, dashboards, and customer portals
  • Business process and workflow automation
  • System integrations
  • Ongoing IT and cybersecurity support plans
  • Other technology services agreed to in writing

The exact services provided to you will be determined by the applicable quote, invoice, service description, statement of work, written agreement, or other written communication between you and IncomiQ.

3. Service Requests Are Not Agreements

Submitting a form, requesting a quote, sending an email, or otherwise contacting IncomiQ does not require IncomiQ to accept your project and does not automatically create a service agreement.

Work will begin only after IncomiQ has accepted the request and any required pricing, scope, payment, deposit, authorization, or project terms have been agreed upon.

We may decline any request or project at our discretion, subject to applicable law.

4. Quotes and Pricing

Prices displayed on IncomiQ.com are starting prices unless specifically identified as fixed prices.

Final pricing may depend on factors including:

  • Project complexity
  • Time required
  • Number of users or devices
  • Required software or hardware
  • Third-party services
  • Licensing costs
  • Integrations
  • Travel or onsite requirements
  • Changes to the requested scope

You will be informed of applicable pricing before paid work begins, unless additional work becomes necessary after the project has started. Additional work outside the agreed scope may require additional payment or a revised quote.

5. Payments and Deposits

Payment terms will be provided with the applicable service, invoice, quote, or project agreement.

Depending on the service, IncomiQ may require:

  • Full payment before work begins
  • A deposit before work begins
  • Milestone payments
  • Final payment before delivery or deployment
  • Recurring payments for ongoing services

Unless specifically included in the quoted price, customers are responsible for third-party costs such as software licenses, subscriptions, hosting, domains, cloud services, hardware, and other outside products or services.

6. Cancellations and Refunds

Refund eligibility depends on the type of service, the amount of work already completed, and any costs already incurred by IncomiQ.

Payments may become partially or fully non-refundable after work begins, particularly where IncomiQ has performed labor, purchased third-party products, reserved resources, created custom work, or incurred other project-related expenses.

Any project-specific cancellation or refund terms included in a quote, invoice, statement of work, or separate agreement will control for that project.

Nothing in these Terms limits any refund, cancellation, dispute, or consumer rights that cannot legally be waived.

7. Customer Responsibilities

You agree to provide accurate information and reasonably cooperate with IncomiQ so that requested services can be completed.

This may include providing:

  • Accurate contact information
  • Access to authorized systems or accounts
  • Required credentials or temporary access
  • Technical information about your environment
  • Timely responses to questions or approval requests
  • Authorization for requested changes

Delays caused by missing information, unavailable systems, third-party providers, or lack of customer response may affect project timelines.

8. Authorization to Access Systems

By requesting services involving a computer, account, network, server, cloud environment, application, or other system, you represent that you own the system or have sufficient legal authority to authorize IncomiQ to access and perform the requested work.

You may not use IncomiQ to gain unauthorized access to another person's device, account, network, software, data, or other system.

9. Remote Access and Technical Support

Certain services may be performed remotely. When remote access is required, you authorize IncomiQ to access the applicable device or system for the purpose of performing the requested service.

Remote access authorization is limited to the agreed service and does not give IncomiQ ownership of your device, accounts, systems, or data.

You should close or secure personal, confidential, or unrelated information before providing remote access when reasonably possible.

10. Backups and Data

Technology work can involve risks including data loss, corruption, configuration changes, hardware failure, software failure, or unexpected incompatibility.

Unless backup services are specifically included in the agreed scope, you are responsible for maintaining current backups of important data before IncomiQ performs technical work.

IncomiQ will use reasonable care when performing services but cannot guarantee that data loss or system failure will never occur.

11. Cybersecurity Services

Cybersecurity services are intended to help identify, reduce, or manage security risks. No cybersecurity service, product, configuration, or technology can guarantee complete protection from every attack, vulnerability, compromise, malware infection, data breach, or other security event.

Security recommendations are based on the information and access reasonably available at the time the service is performed.

Unless specifically agreed otherwise in writing, IncomiQ does not guarantee regulatory compliance, certification, or that a customer will satisfy every legal, contractual, insurance, or industry cybersecurity requirement.

12. Custom Software Development

Custom software projects may be governed by additional project-specific terms covering scope, functionality, milestones, payment, testing, deployment, maintenance, hosting, support, and intellectual property.

Software development may involve third-party libraries, APIs, hosting providers, frameworks, databases, platforms, or other services that IncomiQ does not control.

Changes requested after the agreed project scope may result in additional cost and additional development time.

13. Software Ownership and Intellectual Property

Unless a separate written agreement states otherwise, IncomiQ retains ownership of its pre-existing source code, libraries, frameworks, templates, utilities, development methods, reusable components, internal tools, and intellectual property.

Ownership or licensing rights for custom deliverables created specifically for a customer will be determined by the applicable written project terms.

Any transfer of ownership that is specifically agreed upon is conditioned on full payment of all amounts owed for the applicable project.

Customers retain ownership of their own original data, trademarks, content, files, and other materials supplied to IncomiQ.

14. Business Automation and Third-Party Services

Automation and integration services may depend on third-party software, APIs, websites, cloud services, or platforms.

IncomiQ is not responsible for changes, outages, restrictions, discontinued features, pricing changes, API changes, account suspensions, or other actions taken by third-party providers.

A third-party change may require additional work to update or restore an automation or integration.

15. IncomiQ Care and Recurring Services

Recurring support plans, including IncomiQ Care, provide only the services specifically included in the applicable plan or written agreement.

Unless explicitly stated otherwise, recurring plans do not include unlimited technical labor, unlimited project work, hardware, third-party software, custom development, or services outside the listed scope.

Additional work may be quoted or billed separately.

16. Legal and Prohibited Use

You agree not to use IncomiQ services for illegal, fraudulent, malicious, deceptive, abusive, or unauthorized activities.

Prohibited activities include:

  • Unauthorized access to systems, devices, networks, or accounts
  • Distribution or deployment of malware
  • Credential theft or unauthorized account access
  • Fraud or identity theft
  • Unauthorized surveillance
  • Data theft
  • Attacks against systems you do not own or have permission to test
  • Using IncomiQ services to violate applicable law

We may refuse or terminate services if we reasonably believe a request is unlawful, unauthorized, unsafe, fraudulent, or abusive.

17. Third-Party Products and Services

IncomiQ may recommend, configure, install, integrate, or assist with third-party products and services.

Third-party providers operate under their own licenses, warranties, privacy policies, terms, pricing, and availability. IncomiQ does not control those providers and is not responsible for their independent actions or failures.

18. No Guaranteed Results

IncomiQ will use commercially reasonable efforts to perform agreed services professionally. However, technology environments differ and specific outcomes cannot always be guaranteed.

We do not guarantee uninterrupted systems, complete cybersecurity, permanent compatibility, specific business results, increased revenue, or that every technical issue can be resolved.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, services and website content are provided on an "as is" and "as available" basis except for any express written commitments contained in an applicable service agreement.

We disclaim warranties not expressly provided in writing, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, where legally permitted.

20. Limitation of Liability

To the maximum extent permitted by law, IncomiQ, Nothing But Us LLC, Magnitude Corporation, and their owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of our services.

This may include loss of profits, revenue, business opportunities, data, goodwill, or use of systems.

To the maximum extent permitted by law, our aggregate liability arising from a specific service or project will not exceed the amount you paid IncomiQ for that specific service or project giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply where prohibited by law.

21. Payment Disputes and Chargebacks

If you believe a charge is incorrect or there is a problem with a service, you should contact IncomiQ so the issue can be reviewed.

Fraudulent, knowingly false, or abusive payment disputes may result in suspension or termination of services and collection of amounts lawfully owed.

Nothing in this section prevents you from exercising legitimate rights available through your bank, payment provider, or applicable law.

22. Privacy

Information submitted through IncomiQ.com is handled in accordance with our Privacy Policy.

Please do not submit passwords, private keys, Social Security numbers, financial account credentials, or other highly sensitive authentication information through a general website contact form unless specifically instructed to use an approved secure method.

23. Communications

By submitting a service request, you authorize IncomiQ to contact you using the email address or other contact information you provide for purposes related to your request, quote, project, account, payment, support, or service.

24. Suspension and Termination

We may suspend or terminate services when reasonably necessary, including for:

  • Nonpayment
  • Violation of these Terms
  • Fraudulent activity
  • Unauthorized or illegal use
  • Threats or abuse toward personnel
  • Security risks
  • Material breach of a project agreement

Any outstanding payment obligations that arose before termination remain due unless otherwise required by law.

25. Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with an updated "Last Updated" date.

Updated Terms apply to future use of the website and services after becoming effective, subject to applicable law and any separate written agreement.

26. Entire Agreement and Project-Specific Terms

These Terms apply generally to IncomiQ services. A quote, statement of work, invoice, software development agreement, recurring service agreement, or other written agreement may contain additional or different terms.

If project-specific written terms directly conflict with these Terms, the project-specific terms will control for that project.

27. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
